These terms are an agreement between Whisk Mobile Development Pty Ltd ("we", "our", "us") and you. They cover the Laurels apps for iOS and Android, the website at laurels.fit, and every league page we publish.
Section 3 sets out who these terms apply to and when you accept them. If you create or administer a league, sections 6, 7 and 9 also set out your responsibilities for running it and for the content you publish.
The iOS app is licensed to you under Apple's Standard End User License Agreement, which applies to that app in full and is incorporated here by reference. Where Apple's Standard EULA and these terms conflict in respect of the iOS app, Apple's agreement controls, except where the law says otherwise.
The Android app is distributed through Google Play, and your use of Google Play is governed by the Google Play Terms of Service. Those terms are between you and Google and concern the store rather than this app. The Android app itself is licensed to you by us, under these terms.
Laurels adds up activities and puts them in order. A league administrator decides which sports count and what each is worth, members send activities from their phone, and we publish the resulting table at a public address.
Laurels is not a coach, not a training plan and not a fitness assessment. It does not tell you what to do, how hard to do it, or whether you should.
These terms apply to three kinds of use, and you accept them in a different way in each case.
If you do not accept these terms, do not join or create a league.
Laurels is not intended to diagnose, treat, cure or prevent anything. Using it does not create a professional or clinical relationship of any kind. Nothing it displays is advice about your health.
You are responsible for deciding whether any activity is appropriate for your health, fitness and circumstances. If you are unsure, ask a qualified medical professional before you start.
Members do not need an account in the ordinary sense. One is created anonymously the first time you open the app, and you can optionally attach Sign in with Apple or Sign in with Google so that it survives a lost phone. You may choose any display name, provided it does not impersonate someone else or breach section 10.
Running a league requires an account with a verified email address. We require a verified email address so that we can contact the league administrator about the league. You are responsible for what happens under your account and for keeping access to it.
What we collect and why is described in our privacy policy.
A league administrator sets the activities and their weightings, the start date, whether the league is listed publicly, whether manual entry is allowed, and who may join. Within their own league they can also rename a member, remove a member, void an activity, post announcements, assign members to teams and delete the league. A rename or a removal takes effect without the member's involvement, and a rename changes the name shown on the public page.
An administrator is responsible for:
Where a league is attached to something of value, that arrangement is between the people in the league. We are not a party to it, we do not hold stakes, and we do not decide who won. We do not ordinarily intervene in an administrator's decisions about their own league, except as set out in section 12.
Every league has a page that anyone with the address can read, with no sign-in. A public league may be indexed by search engines. An unlisted league is not private: its address contains random characters so that it is not easily guessed, but anyone who is given the link can view it.
By default a league page publishes the league's name, description and header image; each member's display name, rank, score and recorded totals; individual activities, showing the member's display name, the activity type, its distance or duration, and when it happened; team names and membership counts where a league uses teams; announcements posted by an administrator; and reactions, including the display names of the members who left them.
Do not put anything on a league page you would not want read by a stranger. Our privacy policy describes what is collected and what is published in more detail.
Laurels reports what members' devices sent to it, together with any activity entered by hand where a league allows that. We do not independently verify any of it, and we cannot confirm that an activity took place, that a device measured it accurately, or that manually entered activity data is accurate.
A league table is therefore a record of what was submitted, not a finding of fact about what was done. It has not been independently verified, should not be treated as proof of activity, and should not be used as the sole basis for a decision with significant consequences for anyone. Publishing a figure is not our endorsement of it.
League names, descriptions, header images, announcements, display names and the activities you submit remain yours. By supplying them through Laurels you grant us a non-exclusive, royalty-free licence to store, reproduce and display them for the purpose of operating the service. For content that appears on a league page, that licence extends to publishing it there and in both apps; for an activity you submit, it extends to the totals, rankings and activity entries described in section 7.
You confirm that you have the right to supply what you supply and that it does not infringe anyone's copyright, trade marks, privacy or other rights. This includes confirming that you have permission to use any images you upload.
You agree not to use Laurels to publish or send anything that:
You also agree not to attempt to reverse engineer the apps, bypass any technical restriction, submit fabricated activity data at scale, or interfere with the service or anyone else's use of it.
Physical activity carries inherent risks, including the risk of injury. You are responsible for choosing what activity to undertake and for deciding whether it is appropriate for you, including when participating in a league.
We have no control over what you do, where you do it, or how hard. A league table is a tally of what has been submitted. League standings should not influence you to undertake activity that is unsafe for you. Nothing in this section limits our liability for our own acts or omissions, which is dealt with in sections 13 and 14.
We may remove content, suspend or delete a league, and suspend or delete an account, where we reasonably believe these terms have been broken or where we are required to do so. We review published content after it appears rather than before, so removal may follow publication.
Where it is practical and lawful to do so, we will say why. Deleting a league removes its page and the records associated with it from the live service. Copies may remain for a period in backups and in our operational logs, and we may retain records where we are required to.
We are an Australian company. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, and where a term here would do so, it does not apply to that extent.
Subject to section 13, and to the fullest extent the law allows: Laurels is provided as it is, we do not promise that it will be uninterrupted or error-free, and we are not liable for indirect, incidental, special or consequential loss arising from your use of it. That includes loss arising from data that was inaccurate, delayed, or not delivered.
You agree to indemnify us against any claim, demand, loss or reasonable legal cost brought by a third party arising from your breach of these terms or your infringement of someone else's rights.
Laurels is currently free to use. If we introduce a paid feature, the price, what it covers and the billing period will be shown before you are asked to pay, and nothing in these terms obliges you to pay for anything you have not agreed to buy.
Where a purchase is made through an app store, that store's own billing, renewal and refund policies apply to it. We do not store card numbers.
You can stop using Laurels whenever you like, and you can delete your account from within the app or by the process described at laurels.fit/delete-account. We may end your access under section 12.
Sections 8, 9, 13, 14, 15, 19 and any payment obligation already incurred survive the end of this agreement.
We may update these terms by posting a new version on this page and changing the effective date. Where a change materially affects your rights, we will ask you to agree again rather than only changing the date.
These terms are governed by the laws of Western Australia, Australia, and you agree to the exclusive jurisdiction of its courts, excluding matters governed by Apple's Standard EULA.
